Given that we have all spent more time than ever within our own four walls and gardens of late, it is hardly surprising that search terms like \u201cDo you have a right to sunlight in your garden\/property?\u201d and \u201cCan I ask my neighbour to chop down their trees?\u201d have seen up to 255% growth on Google since the Coronavirus lockdown.<\/p>\n\n\n\n

And in essence, yes, you\ndo have rights when it comes to your property receiving natural sunlight. According\nto The Rights of Light Act 1959<\/a> (ROLA 1959), a neighbour can give this\nright to another neighbour or it can be acquired over time. For example, if a\nproperty has received daylight for at least the last 20 years, you are entitled\nto continue to receive that light. Equally, you are allowed some measure of\naction should an offending tree or shrub be blocking light from your garden. <\/p>\n\n\n\n

However, as with\neverything in life, there are always caveats and council guidelines tend to\ndiffer depending on where you live in the UK, so don\u2019t go taking a chainsaw to\nyour neighbour\u2019s prized plum tree just yet until you have read on to find out\nmore.<\/p>\n\n\n\n

If the issue has arisen\nfrom a neighbour\u2019s overgrown trees or foliage blocking light to your own garden,\nyour first port of call is to check whether the trees are protected under a\npreservation order and if your neighbour\u2019s garden is located in a conservation\narea. It is easy to do so by getting in touch with the local council<\/a> who can confirm this for you. <\/p>\n\n\n\n

If the trees are not\nprotected, you are legally entitled to get out the pruning shears, although you\nare only allowed to cut back overhanging branches which encroach on your own\nproperty, you cannot cross the boundary between your property and your\nneighbour\u2019s property. To retain good relations wherever possible it is always\nbest to mention your plans to your neighbour first, particularly since you are\nliable for any damage to their tree. Seeing if they prefer to undertake the\nwork themselves or handing the job over to a professional tree surgeon (who will\nhave the relevant indemnity insurance should anything go amiss) could be the\nbest option. It is also important to note that all branches and offcuts from\nthe tree belong to the owner of the land on which the tree sits, so you need to\ncheck with your neighbour whether they want these back before you dispose of\nthem. <\/p>\n\n\n\n

Should the offending trees be restricting light to a window or glass house (such as a greenhouse) on your property, the same applies. If your neighbour refuses to let you undertake the, work you can contact your local planning authority<\/a> for more advice on acquiring a Right to Light injunction or damages. <\/p>\n\n\n

Issues around proposed building work (both residential and commercial) which could infringe on light and privacy to an existing dwelling can be slightly more tricky, given that The ROLA is limited to only the right to light through defined apertures into buildings (such as windows). Indeed, section 2 of the ROLA says that:<\/p>\n\n\n\n

“For the purpose of preventing the access and use of light from being taken to be enjoyed without interruption, any person who is an owner of land (in this and the next following section referred to as \u201cthe servient land\u201d) over which light passes to a dwelling-house, workshop or other building (in this and the next following section referred to as \u201cthe dominant building\u201d) may apply to the [F1Chief Land Registrar] for the registration of a notice under this section.”<\/p><\/blockquote>\n\n\n\n

As such, the construction of a new building on an adjacent property which blocks light to the garden or lands of the original property is not said to infringe on the original landowner\u2019s right to light, except in such circumstances where the new construction also blocks light through an aperture which enjoys a right to light.<\/p>\n\n\n\n

Unlike planning law (whereby objections can be lodged for loss of privacy and overlooking), rights to light are classed as private property rights which are beneficial to both residential and commercial properties. Whilst most planning applications take into account the 45-degree rule (used by many local planning authorities to determine the impact of a new development on sunlight and daylight to adjacent buildings), private rights of light need to be addressed separately and often via the court system if a development infringes sufficiently on the right of a neighbouring property and an agreement cannot be reached privately by the developer and affected property owner. This can lead to a protracted and costly legal battle resulting in either changes to or a cessation of the development entirely or the awarding of damages to the property owner. The development can also range from a shed or garden wall through to private extensions and larger housing or commercial developments. <\/p>\n\n\n\n

In December 2014, the Law Commission completed a review<\/a> of the ROLA 1959, calling for more transparency (no pun intended). Specifically, this included recommendations for time limits on claims for loss of light, clarity around when damages should be awarded and when a development should be halted\/demolished and amendments to the law in respect of unused rights to light. Whilst there are no plans to make any changes to the ROLA 1959 at present, it is important to keep up to date with these rights, whichever side of the fence you are on. <\/p>\n\n\n\n
