{"id":1869,"date":"2025-08-14T19:05:24","date_gmt":"2025-08-14T19:05:24","guid":{"rendered":"https:\/\/www.yopa.co.uk\/homeowners-hub\/?p=1869"},"modified":"2025-08-31T08:14:07","modified_gmt":"2025-08-31T08:14:07","slug":"can-you-sell-a-house-without-the-deeds","status":"publish","type":"post","link":"https:\/\/dy36.stage.yopa-dev.co.uk\/homeowners-hub\/can-you-sell-a-house-without-the-deeds\/","title":{"rendered":"Can you sell a house without the deeds?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The\ndeeds \u2013 or \u2018title deeds\u2019 to give them their full name \u2013 are essentially the\npaperwork that proves ownership of a house or piece of land (or both, in the\ncase of&nbsp;<a href=\"https:\/\/www.yopa.co.uk\/homeowners-hub\/what-does-freehold-mean\/\">freehold<\/a>&nbsp;properties). <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And\nyes, you can, in theory, sell or&nbsp;<a href=\"https:\/\/www.yopa.co.uk\/homeowners-hub\/how-do-you-remortgage-your-house\/\">remortgage<\/a>&nbsp;a house without the deeds.\nHowever, you must prove you own the property to do so.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What\ndo the deeds actually include? <\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Deeds\nare generally made up of the following documents, and every time the property\nis bought and sold the deeds are updated to show the new ownership:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><a href=\"https:\/\/www.yopa.co.uk\/homeowners-hub\/conveyancing-everything-need-know-afraid-ask\/\">conveyancing<\/a>&nbsp;documents<\/li><li>contracts for sale<\/li><li>wills<\/li><li>mortgages<\/li><li><a href=\"https:\/\/www.yopa.co.uk\/homeowners-hub\/what-is-leasehold\/\">leases<\/a><\/li><li>details of any&nbsp;<a href=\"https:\/\/www.yopa.co.uk\/homeowners-hub\/what-are-restrictive-covenants\/\">restrictions<\/a>&nbsp;on how the\n     property may be used.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>How do you prove that you own the property if you don\u2019t have the deeds?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s\nnot uncommon for the owner to mislay the deeds for their property, or to have\nnot received a copy in the first place, as there is no legal requirement for\nthe deeds to be passed on when the property is sold. The sale just needs to be registered\nwith the&nbsp;<a href=\"https:\/\/www.gov.uk\/government\/organisations\/land-registry\">Land Registry<\/a>. If you\u2019re selling a property\non behalf of the owner, such as an elderly or <a href=\"https:\/\/www.yopa.co.uk\/homeowners-hub\/what-is-a-probate-property-valuation\/\">deceased<\/a> relative, you may also struggle\nto track down a copy of the original deeds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If\ndeeds have been lost or destroyed, the first port of call is to check whether\nthe property is registered with the Land Registry. It is the Land Registry\u2019s\nresponsibility to register land and property across England and Wales.&nbsp;<a href=\"https:\/\/www.ros.gov.uk\/our-registers\/land-register-of-scotland\">Scotland<\/a>,&nbsp;<a href=\"https:\/\/www.landregistryireland.com\/\">Ireland<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.finance-ni.gov.uk\/articles\/overview-land-registration\">Northern Ireland<\/a>&nbsp;have their own separate\nland registry organisations.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Property\nregistration became compulsory in England and Wales in 1990. When a property is\nregistered with the Land Registry for the&nbsp;<a href=\"https:\/\/www.gov.uk\/registering-land-or-property-with-land-registry\/register-for-the-first-time\">first time<\/a>, the Land Registry will take a\nscanned copy of the original title deeds before returning them to whoever\nsubmitted them. This will generally be a solicitor or conveyancer who is acting\non behalf of a buyer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If\nyour property is registered with the Land Registry, you don\u2019t need the deeds to\nconfirm your ownership as the Register is the definitive record of ownership\nfor land and property in England and Wales. They will be able to provide the\nnecessary information required to complete your house sale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even\nif your property&nbsp;<em>is<\/em>&nbsp;registered with the Land Registry though,\nit is still helpful to retain or locate a copy of the original deeds since they\ncan provide useful additional information on areas such as legal boundaries.\nYou can view an electronic copy of any deeds that the Land Registry has on file\nfor your home by searching their&nbsp;<a href=\"https:\/\/www.gov.uk\/search-property-information-land-registry\">property information listing<\/a>&nbsp;to\nfind your property\u2019s title number. If there is a reference to&nbsp;<em>filed<\/em>&nbsp;deeds,\nthey will have copies which you are able to&nbsp;<a href=\"https:\/\/www.gov.uk\/get-information-about-property-and-land\/copies-of-deeds\">purchase<\/a>&nbsp;for \u00a37.00 per document.\nThe Land Registry will be able to let you know the total price for all\ndocumentation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There\nare still a number of unregistered properties in existence (approximately 14%\nof freehold properties in England and Wales), which are generally properties\nwhich have not been remortgaged or sold since 1990. If your property falls into\nthis category and you do not have the original property deeds, it will take a\nlot more effort to prove ownership, but it can be done.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>How\nto prove ownership if your property is not registered with the Land Registry<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The\nfirst option is to track down the original deeds. Contact the solicitor or\nconveyancer used when you (or the owner if you are acting on someone\u2019s behalf)\nbought the property as they may still have copies of your deeds on file.\nAlternatively, if you took out a mortgage when you bought the property, the\ndeeds may be with your original mortgage lender \u2013 or your current lender if you\nhave subsequently&nbsp;remortgaged.&nbsp;If you have&nbsp;<a href=\"https:\/\/www.yopa.co.uk\/homeowners-hub\/selling-inherited-property\/\">inherited<\/a>&nbsp;a property or are selling\na property via probate, then it may be that the solicitor who produced the will\nfor the deceased person has the deeds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If\nyou are unable to locate the original deeds, you will need to apply for&nbsp;<a href=\"https:\/\/www.gov.uk\/government\/publications\/first-registration-of-title-where-deeds-have-been-lost-or-destroyed\">first registration<\/a>&nbsp;of\nthe property. This is a complex process and will require the assistance of an\nexperienced solicitor or conveyancer. Depending on the complexity of the\nsituation it can also be a lengthy and costly process, so make sure you have\nfactored this into your timings and budget for the sale. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To\ncomplete the first registration, you will need provide a&nbsp;<a href=\"https:\/\/www.gov.uk\/government\/publications\/statements-of-truth\/practice-guide-73-statements-of-truth\">statement of truth<\/a>&nbsp;via\nan&nbsp;<a href=\"https:\/\/www.gov.uk\/government\/publications\/lost-or-destroyed-deeds-statement-of-truth-st3\">ST3<\/a>&nbsp;form and accompanying\nevidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This\nevidence can be in the form of mortgage payment records, bank statements,\nutility bills, buildings insurance policies, electoral roll records, copies of\ncontracts and estate agent property details. Supporting statements from a\nmortgage provider, solicitor or former and current neighbours can also be\nconsidered. You will also need to:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Identify the property to be registered, on a plan drawn up when it was built if possible.<\/li><li>Show what you have done to try and locate the missing deeds. <\/li><li>Provide an account of how and where the deeds came to be lost or destroyed and why they were in this location \u2013 e.g. if they were with a conveyancer or mortgage provider who has since ceased trading.<\/li><li>Show who owned the property when the deeds were lost.<\/li><li>If applicable, prove there was a mortgage on the property when they were lost and who was paying it.<\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<p>The deeds \u2013 or \u2018title deeds\u2019 to give them their full name \u2013 are essentially the paperwork that proves ownership of a house or piece of land (or both, in the case of&nbsp;freehold&nbsp;properties).
