You will also need to undertake conveyancing for a remortgage or the extension of a lease on a leasehold property. \u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A solicitor or conveyancer will undertake this legal work on your behalf whether you are the buyer or the vendor of a property (or both). They will primarily be responsible for:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>drawing up contracts of sale<strong><\/strong><\/li><li>providing legal advice<strong><\/strong><\/li><li>carrying out <a href=\"https:\/\/hoa.org.uk\/advice\/guides-for-homeowners\/i-am-buying\/local-authority-searches-explained\/\">local searches<\/a><strong><\/strong><\/li><li>liaising with the <a href=\"https:\/\/www.gov.uk\/government\/organisations\/land-registry\">Land Registry<\/a><strong><\/strong><\/li><li>transferring the money for the purchase<strong><\/strong><\/li><li>ensuring that the legal ownership of the property\nmoves from the vendor to the buyer <strong><\/strong><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Whilst it is not a legal requirement to use a solicitor or conveyancer to transfer ownership of a property \u2013 particularly if you have experience in land transfers and the process surrounding it \u2013 our detailed article <a href=\"https:\/\/www.yopa.co.uk\/homeowners-hub\/conveyancing-everything-need-know-afraid-ask\/\"><em>The Ultimate Guide to Conveyancing<\/em><\/a> explains the reasons why you should to avoid very costly and time-consuming pitfalls. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>The difference\nbetween a conveyancer and solicitor<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Prior to the Administration\nof Justice Act 1985, the use of a solicitor was always required for the\ntransfer of land. After this point, licenced conveyancers, who are responsible\nfor the facilitation of land transfer but are not qualified to work outside of\nproperty law could also undertake the same role.&nbsp; &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The advantage\nof using a conveyancer is that they are generally less expensive than\nsolicitors and since they only handle land transfers, they may be more familiar\nwith the process than a solicitor who specialises in a range of legal processes\nand isn\u2019t undertaking conveyancing work day in, day out. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, for a\nmore complex sale which involves other legal aspects such as divorce, probate\nor bankruptcy you would need the expertise of a conveyancing solicitor who is\nfully trained in all aspects of the law since a conveyancer\u2019s expertise is\nlimited solely to property conveyancing law. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>At what\nstage in the transaction should you employ your conveyancer? <\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">As soon as you\nmake or accept an offer on a property, you will need to make sure you have a conveyancer\nor solicitor in place to oversee the transfer of legal ownership for the\nproperty you are buying or selling (or both if you are selling your own\nproperty and buying a new one). &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As such, it pays to do some research once you begin your property search or put your own home on the market so that you have a good idea of who you will use to avoid any unnecessary delays. Start comparing conveyancers early so you can choose with time to spare. Check that the firm is regulated, what the service covers, the total fee including VAT and disbursements, and how they will keep you updated.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>How to find\na good conveyancer or conveyancing solicitor<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Once you have\ndecided whether you require the services of a conveyancer or a conveyancing\nsolicitor, where do you find them?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The best\nreferrals so often come via word of mouth, and friends and family can be a\nuseful port of call since we all need to move house at some point. Depending on\nthe complexity of the sale, it may not be necessary to meet with your\nconveyancer face-to-face and there is a growing market in online conveyancing. However,\nthis could potentially add more time to the conveyancing process if you need to\nexchange hard copies of documentation or find yourself dealing with a different\nconveyancer whenever you pick up the phone. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Estate agents (both high street and online), mortgage brokers and accountants work with solicitors and conveyancers on a regular basis and can often provide useful recommendations. If you have needed to use a solicitor in the past for other reasons, they may also be able to recommend a colleague who specialises in conveyancing. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a legal requirement that all qualified solicitors and licenced conveyancers in the UK are fully regulated and insured. In England and Wales, solicitors are regulated by the Solicitors Regulation Authority and are also required to be a member of the Law Society of England and Wales. In Scotland, where the <a href=\"https:\/\/www.which.co.uk\/money\/mortgages-and-property\/first-time-buyers\/buying-a-home\/how-to-buy-a-house-a8zHm0a1JZsP#buying-a-house-in-scotland\">conveyancing process<\/a> is slightly different, solicitors are regulated by the Law Society of Scotland. Leasehold properties with complex lease arrangements in place can often result in costly conveyancing fees. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As part of the conveyancing process, you will also need to pay the cost of \u201cdisbursements\u201d. Disbursements are the costs for the services of other parties involved in the conveyancing process, such as local authority searches, the Land Registry fee for transferring ownership, anti-money laundering checks, the bank transfer fee and <a href=\"https:\/\/www.yopa.co.uk\/homeowners-hub\/stamp-duty-calculator\/\">stamp duty<\/a>.
