Unfortunately the results of a survey aren’t always perfect, and buyers can be faced with a logistical nightmare if they find defects or problems, particularly around structural integrity. Luckily, if you’re concerned that the cost of putting these issues right will send you over budget, you have options!

Essentially you can either go ahead with the agreed offer price, walk away from the sale entirely, or find a middle ground and renegotiate the price you have offered.

Whilst you may have already gone back and forth with the vendor to reach a mutually agreed price prior to your survey, as the buyer you are completely within your rights to renegotiate if the survey reveals unexpected issues which impact the property’s value. Your mortgage lender may even decide that the property isn’t worth the price originally offered and refuse to loan you this amount in light of the survey findings, leaving you with no choice but to withdraw or get the price down.

So, when it comes to renegotiating the price you wish to pay for a new home, what can you do – and what should you avoid?

Do this…

Before you do anything else, do speak to your surveyor so you understand the implications of anything highlighted in their report. They will advise you on next steps, whether any further investigations are required and give you a comprehensive breakdown of the survey, all of which is included in the price you have paid for the survey. Don’t be afraid to ask for advice!

Do be realistic about what constitutes a significant issue with the property. A surveyor is obligated to point out every current and potential future issue they see, no matter how small. Your vendor is not going to drop the price significantly for minor cosmetic repairs or because you would prefer not to have a flat roof on the garage. If the property has been priced competitively for its type and location the vendor is also unlikely to drop the price due to work that you could do yourself with a little elbow grease, or which isn’t necessary in the near future.

Do get in touch with the vendor as soon as possible to share the
findings of your survey report so they have plenty of notice of your intention
to renegotiate. They may not be aware of the issues your survey has uncovered and if
they are in a chain themselves, they will want to resolve any issues quickly.
If time is not of the essence, the vendor may be willing to fix any maintenance
issues prior to completing the sale rather than drop the price or have to put
the property back on the market. Finding a new buyer is a pain, and if your
vendor sees that you are being genuine and not trying to gazunder they are more likely to be willing to renegotiate.

Do make sure you have done your research. For things like damp issues, a
separate damp survey will show the extent of the problem and the cost for
repairs as this can vary massively. A defect report will also focus on areas of
particular concern. If you can collect and present various quotes for any
maintenance work or additional legal fees to support your request to lower your
offer price, then the vendor is more likely to agree to reduce the price. They
may come back with a counteroffer, so do ensure that any tradesmen or legal
professionals they suggest are adequately trained and that they have the necessary
skills to undertake the work themselves if they propose to do so.

But don’t…

Don’t wait until after you have exchanged contracts to try and negotiate a different offer price. In England and Wales, before you exchange your sale is still subject to contract. This means you can withdraw your offer, but you may lose money you have already spent, such as survey and legal fees. Once you have exchanged contracts you are legally obliged to pay the agreed upon price unless the vendor agrees to negotiate and you will lose your deposit if you walk away from the sale. You may potentially be subject to other penalty fees as well.

Don’t immediately walk away if you come across prohibitively expensive issues or red tape. For issues that can’t be resolved or would cost a significant sum to do so, such as work completed without planning permission, breaches of a restrictive covenant by a former owner or no formal right of easement, you can ask your conveyancer whether indemnity insurance is suitable. This insurance covers future homeowners as well the person who takes out the policy, and you can always request that the vendor covers the cost for the indemnity insurance or deducts the amount from the house price. However, it won’t be appropriate in every case so always check!

If you have reached an agreement with the vendor that they will complete
remedial work before you buy the property, don’t forget to include this
information in the contract, along with the specific details of the work to
be carried out. If it isn’t in the contract, they are not legally obliged to
undertake the work.

Don’t forget that the vendor will have a bottom line when it comes to
price. They will more
than likely need the money from this sale to fund the purchase of their next
property and will only be able to drop the price by a limited amount. At the
end of the day, the value of the property is what a buyer is willing to pay and
what a vendor is willing to accept. If the property is in a sought-after area
in a seller’s market there will always be someone else willing to pay asking price,
but you shouldn’t put yourself into a massive amount of debt for remedial work
and have your dream home become a nightmare. There will always be other
properties.

            Instant online valuation

Get a rough estimate of your home's value now.

            Face-to-face valuation

Book an appointment with your local Yopa agent.

In a perfect world all home purchases go smoothly and home buyer surveys don’t throw up any issues.
