A \u201cparty wall\u201d, sometimes known as a parting wall<\/em> or common wall<\/em>, is the shared dividing wall between two or more adjoining properties and was introduced as far back as the 11th<\/sup> century as a fire safety requirement for London\u2019s many terraced homes, particularly in the wake of the Great Fire of 1666. This wall can either form part of the buildings in question or be a boundary such as a garden wall and refers to both residential and commercial properties. <\/p>\n\n\n\n

Wooden garden fences are not considered party walls and your\ntitle deeds will tell you which fence is your responsibility (generally it will\nbe the fence on your righthand side and at the back as you look out into the\ngarden from the rear of the property). If you have any queries about the\nboundaries for your property, then you can get a copy of your title plan or\napply to have this amended via the Land Registry<\/a> if you\nlive in England or Wales. There are different processes in place in Northern Ireland<\/a> and Scotland<\/a>.  <\/p>\n\n\n\n

A \u201cparty structure\u201d is a structure which separates two or\nmore buildings or different parts of the same building which belong to\ndifferent owners, such as a floor in a block of flats.<\/p>\n\n\n\n

Often when a developer is building a number of properties at\nthe same time, they will lay a wall along the property line which divides two\nterraced or semi-detached houses, with 50% of the wall on either side of the\nproperty line. However, party walls can also be created by two adjacent walls\nwhich have been built at separate times, or in the case of a non-structural\nparty wall, a firewall or insultation layer between properties, particularly in\nblocks of flats. <\/p>\n\n\n\n

Legally, there are a number of definitions as to the\nownership of a party wall, which depend on the individual circumstances of the\nbuilding(s) in question. The wall is not always considered the median\ndemarcation of property boundaries either, and the legal boundary can stop at\nthe very edge of a wall or somewhere within it that is not the central\npoint.  <\/p>\n\n\n\n

However, when it comes to common ownership, property owners\nwho are immediately adjacent to the wall have the right to use or benefit from\nthe wall and for it to be retained even if they do not have legal ownership of said\nwall. In fact, it is a requirement of the Party Wall etc Act 1996<\/a> in\nEngland and Wales that you inform your neighbours in advance of any work that\nyou wish to undertake near to or on the party wall or a shared property\nboundary and seek their formal agreement. <\/p>\n\n\n\n

A party wall agreement is separate to planning permission<\/a> or building regulations approval<\/a>, for\nwhich there are different processes in place. We will consider the process for\na party wall agreement in more detail below. <\/p>\n\n\n\n

Again, there are different processes in place in Northern Ireland<\/a> and Scotland<\/a> in this\nsituation.<\/p>\n\n\n\n

A Party Wall Agreement or Award <\/strong><\/h3>\n\n\n\n

If you wish to undertake any building work on or near a party\nwall or dig below the wall near the foundations of your neighbour\u2019s property,\nyou must inform them in writing with a party wall notice (you can of course\nnotify them verbally first of course as well) and provide a minimum of 2\nmonths\u2019 notice of your intentions. You must then create a party wall agreement\ntogether in writing. <\/p>\n\n\n\n

Whilst your neighbours cannot prevent you from undertaking\nwork on your property if the changes are permissible by law, they can have an\nimpact on when and how exactly the work is undertaken. As well as giving or\nrefusing consent (which will open a dispute resolution process) your neighbour\ncan also provide a counter notice, whereby they request additional work be\nundertaken at the same time. They have 14 days within which they must let you know\nwhether or not they consent to the work, and a month to provide a counter\nnotice. You must respond in writing to any counter notice within 14 days. You\ncannot continue with the work until you have received a response from your\nneighbour and if you do not receive a response at all within the required\ntimescales then the dispute resolution process will begin automatically.<\/p>\n\n\n\n

When it comes to the payment for any works undertaken to a\nparty wall, if you commence the works you will need to pay for them, although\nyour neighbour(s) may have to contribute if the work is due to a specific\nmaintenance issue or the wall being in a bad state of repair. Equally, they\nwill need to cover the cost of any additional works they request which are\nbeneficial to them.<\/p>\n\n\n\n

If you cannot reach an agreement with your neighbours, you\nwill need to appoint a qualified surveyor<\/a> (or\nsurveyors if you each prefer to appoint your own) to produce a legal document\ncalled a \u201cparty wall award\u201d which states what type of work should be carried\nout, how and when this should happen and how the payment should be split\nbetween you and your neighbour (this will also include the cost of the\nsurveyor\u2019s fees).<\/p>\n\n\n\n

You do have the option to appeal the party wall award, but\nthis will need to happen within 14 days of your receiving it via the county\ncourt process.  <\/p>\n\n\n\n

Once you have an agreed upon party wall agreement or award in\nplace, you will need to ensure that any work does not cause \u201cunnecessary\ninconvenience\u201d and that you provide at least 14 days\u2019 warning of any works\ntaking place, emergencies notwithstanding. You must also make sure that the\nwork will not have a negative effect on your neighbour\u2019s property, and should\nany damage occur you must cover the cost for rectifying it. They in turn must\nallow professionals such as surveyors and builders access to their property\nduring reasonable working hours whilst the work takes place.  <\/p>\n\n\n\n

When it comes to small updates such as replastering, rewiring\nor affixing shelving to the wall, you are not obliged to produce a party wall\nnotice. However, if it will be a noisy job it is generally a courtesy to inform\nyour neighbours and avoid antisocial hours for undertaking the work to retain a\ngood relationship with your neighbours.  \n<\/p>\n\n\n
