{"id":2684,"date":"2021-08-27T12:45:03","date_gmt":"2021-08-27T12:45:03","guid":{"rendered":"https:\/\/www.yopa.co.uk\/homeowners-hub\/?p=2684"},"modified":"2021-08-27T12:47:23","modified_gmt":"2021-08-27T12:47:23","slug":"what-can-you-do-about-noisy-neighbours","status":"publish","type":"post","link":"https:\/\/dy36.stage.yopa-dev.co.uk\/homeowners-hub\/what-can-you-do-about-noisy-neighbours\/","title":{"rendered":"What can you do about noisy neighbours?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">As the unlucky amongst\nus know, your dream home can very quickly become a bit of a nightmare if the\npeople living next door are less than neighbourly. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With <a href=\"https:\/\/www.gov.uk\/government\/statistics\/monthly-property-transactions-completed-in-the-uk-with-value-40000-or-above\/uk-monthly-property-transactions-commentary\">record<\/a> numbers of us moving house from July 2020 to July 2021 in\na bid to find more covid-free space and take advantage of the temporary\nreduction to stamp duty rates, the contentious issue of antisocial neighbours could\nalso be on the rise. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, do you have\nany legal rights when it comes to tackling noisy neighbours? Read on for more\nadvice, whether it be raucous late-night parties keeping you up all night (And\nsadly, not your own!), persistent, loud construction work or noisy neighbours\nof the canine variety.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">First and\nforemost, if you are being disturbed by noise from a neighbouring residential property\nor commercial premises always speak to your neighbour(s) directly and in a\nnon-confrontational way to raise your concerns. Noise carries easily after all,\nand the best-case scenario is that they may not be aware and can make some\nchanges that still accommodate both parties. You should also make sure that you\nhave made a note of specific instances of disturbance in case you need to raise\nyour concerns more formally via the local council, police or court of law. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the property\nis tenanted, you might also need to contact your neighbour\u2019s landlord or <a href=\"https:\/\/www.gov.uk\/government\/publications\/current-registered-providers-of-social-housing\">housing association<\/a> since they may be able to rectify the\nissue in a variety of ways such as installing carpets or better insulation\nbetween properties when it comes to flats, terraces or semi-detached properties.\nOrganisations like <a href=\"https:\/\/www.citizensadvice.org.uk\/housing\/problems-where-you-live\/complaining-about-your-neighbour\/\">Citizens Advice<\/a> can provide support and guidance on\nyour specific rights to the quiet enjoyment of your property free of charge and\nthe <a href=\"https:\/\/www.housing-ombudsman.org.uk\/residents\/make-a-complaint\/\">Housing Ombudsman<\/a> can investigate if you are unhappy with\nthe response you receive from a housing association. However, they will only do\nso 8 weeks after your have received a final reply from the housing association\nin question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you are\nfinding it difficult to reach a middle ground with your neighbour, you can\nalways seek impartial support from a <a href=\"https:\/\/www.gov.uk\/how-to-resolve-neighbour-disputes\/use-a-mediation-service\">mediation service<\/a> to help you find a solution everyone is\nhappy with. Some local councils also provide a mediation service for this kind\nof issue. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Should an\namicable solution not be reached between you and your neighbour, and you need\nto take the noise issue further, your local council is obliged to investigate\nany noise complaints which are deemed to be a \u201cstatutory nuisance\u201d. The\nGovernment <a href=\"https:\/\/www.gov.uk\/guidance\/noise-nuisances-how-councils-deal-with-complaints\">classifies<\/a> a statutory nuisance<strong>*<\/strong> as something\nwhich:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>unreasonably\nand substantially interferes with the use or enjoyment of a home or other\npremises, or &nbsp;<\/li><li>can\ninjure health or be likely to injure health. <\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>*<\/em><\/strong><em>A statutory nuisance is not confined to\nissues of noise pollution and also includes issues such as artificial light\n(apart from streetlamps), unpleasant emissions from business premises such as\ndust, steam, smell or insects, smoke, fumes or gases or an accumulation of rubbish\nor debris which could be hazardous to health. If they\ndecide that this is the case, they will serve the responsible individual or the\nproperty owner (depending on the specific situation) with a <a href=\"https:\/\/www.gov.uk\/guidance\/statutory-nuisances-how-councils-deal-with-complaints#abatement-notices\">noise abatement order<\/a>. The order will specify the steps the\nperson needs to take to rectify the situation such as reducing the noise level,\nor only permitting the noise to occur during specified hours. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If these steps\nare not taken or the order is ignored, then legal action may be taken. Councils can also remove specific noise-making\nequipment such as loudspeakers or machinery from the premises. There are\nspecific guidelines and processes when it comes to noise from <a href=\"https:\/\/www.gov.uk\/guidance\/noise-nuisances-how-councils-deal-with-complaints\">intruder alarms, construction work or\nindustrial, trade or business premises<\/a>\ntoo. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When it comes\nto prosecution, the court can set a lump sum fine and further fines for each additional\nday of noncompliance with the abatement order as well. The council can also\nundertake work to stop or restrict the noise at the cost of the person issued with\nthe order and\/or apply to the High Court for an injunction. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you yourself\nhave been served with an abatement order which you wish to appeal, you can do\nso via the local magistrate\u2019s court within 21 days of receiving the order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since issues of\nnoise pollution can cross over with the work of the <a href=\"https:\/\/www.gov.uk\/guidance\/check-if-you-need-an-environmental-permit\">Environment Agency<\/a>, particularly when it comes to commercial\npremises, your local council will need to ensure that the property in question\nisn\u2019t already covered by an environmental permit. A noise abatement order can\nstill be set in this instance and prosecution for breach of the order pursued,\nhowever this would involve input from the Secretary of State. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the noise issue\nis not resolved and\/or you are unhappy with the way the council has handled\nyour noise concern you can also contact the <a href=\"https:\/\/www.lgo.org.uk\/\">Local\nGovernment and Social Care Ombudsman<\/a>.\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For issues of\nserious anti-social behaviour or any threat to your personal safety you should\nalso <a href=\"https:\/\/www.gov.uk\/contact-police\">contact the police<\/a>.\nThis can be done online or by calling 101 for non-emergencies. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>As the unlucky amongst us know, your dream home can very quickly become a bit of a nightmare if the people living next door are less than neighbourly.
