Depending on the type of house\nsale you are involved in, there can also be a few extra complexities to be\ntaken into consideration alongside these core duties. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Firstly, are you selling a <a href=\"https:\/\/www.yopa.co.uk\/homeowners-hub\/what-is-leasehold\/\">leasehold<\/a> property? If you are, then the owner of the <a href=\"https:\/\/www.yopa.co.uk\/homeowners-hub\/what-does-freehold-mean\/\">freehold<\/a> may insist that you use a solicitor or conveyancer for the house sale. Indeed, some banks will even require you to use one\nof their own recognised solicitors for the property transaction, so bear that\nin mind and be prepared to be flexible in this case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thirdly, if you\ndecide to go it alone when it comes to conveyancing you are likely be uninsured\nagainst mistakes or oversights, unlike a legal professional who will be covered\nby professional indemnity insurance. Therefore, if you do end up making any\nerrors during the conveyancing process, then you are potentially opening\nyourself up to the possibility of being sued and \u2013 as a consequence \u2013 spending\nextra money in legal and court fees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finally, if you\nhave an outstanding mortgage then the buyer\u2019s solicitors are unlikely to accept\nany \u2018undertaking\u2019 from you as an individual without a legal professional as a\ngo-between. (An undertaking is a promise between solicitors or conveyancers\nthat any remaining mortgage will be paid off using the proceeds from the property\u2019s\nsale).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In summary, it is perfectly possible to sell your property without a solicitor \u2013 and in some cases, this can be a good option.
