Since the Town and
Country Planning Act 1947 came into effect on 1 July 1948 to reduce the risk of urban sprawl,
planning permission from the local authority has been
required before commercial or residential development can commence, or land or
buildings are subject to a change of use.

However, from
15 April 2015, the government introduced an amendment to the Act – catchily
known as The Town and
Country Planning (General Permitted Development) (England) Order 2015, or the GPDO –
in an effort to increase the construction of new homes. The amendment means
that many homeowners now also have the opportunity to modify their properties without
seeking planning permission via something called householder
permitted development rights. However, these rights are quite specific.

For instance,
there are national restrictions on the height, size and location of any extensions
to an existing property. To qualify for permitted development rights, any
extension to your property will usually need to:

Cover less than fifty per cent of the area of land around the
original dwelling.

Be within two metres of your property’s boundary and have a maximum
height at the eaves of three metres or less.

Be shorter than the tallest part of your existing roof, and lower
than the existing eaves.

Not exceed four metres in height for single storey side extensions
or exceed half the width of the original dwelling.

Measure a maximum of four metres for a detached house and three
metres for all other types of house when it comes to single storey rear
extensions. This can increase to eight metres and six metres respectively if
prior approval is sought from the local authority. (More on that below).

A multi-storey rear extension cannot extend past the rear of the
original dwelling by more than three metres, be within seven metres of any
boundary opposite the rear wall of the house and have obscure-glazed
upper-floor windows to the side elevation. The roof pitch must match the
existing house as far as practicable also.

Multi storey side extensions will always need planning permission.

Be made from materials similar to those used in the existing
dwelling.

Exclude all of the following.

A veranda

A raised platform

A balcony

A chimney, flue or vent pipe

A TV aerial or satellite dish

But what if you
live in a conservation area? Are permitted development rights still applicable
or do you need planning permission to undertake any renovation work to your
home?

What is a
conservation area?

A conservation
area, much like a National Park, Area of Outstanding Natural Beauty (ANOB) or
World Heritage Site is classed as a ‘designated area’ under Article 2(3)
designated land of
the GDPO.

This means that
any property development is more restricted and you are likely to require planning
permission for work which would usually fall under permitted development rights
for properties which are not located in a designated area.

For instance,
any side extension, regardless of the size of the original building, the
extension or the distance from neighbours will need planning permission in a
conservation area, as will rear extensions which exceed one storey.

So, how do you
know if you live in a conservation area?

If you live in
any kind of designated area, it is likely that you will have been made aware
when you bought your home, or it will be mentioned in the deeds. However, if
you think you may live in a designated area, but you are unsure, you should
check with your local authority.

Are there other
cases when permitted development rights are not applicable?

Similarly to
buildings in designated areas, there are additional requirements for listed buildings too.

Permitted development
rights are also not always applicable for shared occupancy buildings like flats
and maisonettes, even those which were themselves created via householder permitted
development rights or a change of use application.

When it comes
to public buildings and commercial properties, there are also different
permitted development rights in place, which can be found here. This includes
time
limitations on
when certain types of work can be undertaken.

Any development
which is specified as having an environmental impact in the Town and
Country Planning (Environmental Impact Assessment) Regulations 2017 or a significant
effect on a Habitats site
or a European Offshore Marine Site is also likely to be subject to more stringent rules. Article 3 of
the GPDO provides more details.

So how do you
know whether permitted development rights apply?

Regardless of
whether you live in a conservation area or not, it is always advisable that you
contact your local planning authority to discuss your plans before any building
work begins, even if you feel that it falls under permitted development rights.

Your local
authority will then confirm:

If they can
automatically grant what is referred to as prior approval.

Whether you are
required to submit a prior approval
application.

Any specific
reasons why you would need to submit a full planning application for all or
part of the work. Say for instance that your home has previously received an Article 4 direction or
restrictive conditions whereby some or all of your permitted development rights
have been removed.

            Instant online valuation

Get a rough estimate of your home's value now.

            Face-to-face valuation

Book an appointment with your local Yopa agent.

When it comes to extending or improving a property in the UK, homeowners do not have carte blanche to build whatever their heart desires.
