Picture the\nscene \u2013 you\u2019ve been through the lengthy process of searching for your dream\nhome, and you\u2019ve finally found a property that perfectly fits the bill. You\u2019ve\ndone your sums, and miraculously it\u2019s within budget \u2013 so you take the plunge\nand make an offer. Negotiations are made, counter offers are discussed and a deal\nis struck: your offer has been accepted!<\/p>\n\n\n\n

But it\u2019s not\ntime to crack open the champagne just yet. There is still a chance you could be\n\u2018gazumped\u2019. But what does this mean, exactly? Well, unfortunately, gazumping<\/em>\nis the process whereby another party makes a better offer than yours which is\nthen accepted by the vendor, even though they have already agreed to sell to\nyou.  <\/p>\n\n\n\n

You are thus back to square one, and potentially a fair bit out of pocket if you have already paid for legal advice<\/a> and a survey<\/a> for the property in question. <\/p>\n\n\n\n

In this\narticle, we explore how gazumping works; whether you can avoid it; and what to\ndo if it happens to you\u2026<\/p>\n\n\n\n

How does\ngazumping work?<\/strong><\/h3>\n\n\n\n

In the majority of cases, gazumping occurs when another buyer offers the vendor more money. Whilst you can curse their greediness all you want, it is the seller\u2019s prerogative to maximise their income from the sale. They are therefore likely to take the higher offer at the expense of yours if you have not already signed a legally binding contract<\/a>.<\/p>\n\n\n\n

Sometimes, you\nmay be gazumped by someone who can move more quickly than you, even if they\naren\u2019t necessarily offering any more money for the house. If things are being\nheld up with the sale of your current home for instance, and the necessary\nsurveys and legal paperwork are taking too long, the vendor may decide to sell\nto a buyer who isn\u2019t caught up in a chain if they themselves have time\npressures when it comes to purchasing their next property.<\/p>\n\n\n\n

Unfortunately, you can be gazumped at any point between making an offer and exchanging contracts when the sale becomes legally binding. So definitely don\u2019t put the bubbly on ice until you\u2019ve reached that crucial stage of no return!<\/p>\n\n\n\n

Your vendor is less likely to pull out of the sale after you have exchanged contracts. However, if they do, you would be within your rights to sue them for breach of contract. <\/p>\n\n\n\n

Is gazumping\nlegal?<\/strong><\/h3>\n\n\n\n

The short\nanswer is yes, unfortunately gazumping is legal. As unfair as it may seem, the\nsale is not a done deal until you\u2019ve exchanged signed contracts. Up until this\npoint, it is an unwritten agreement that can be reneged upon by the vendor, or\nthe buyer.<\/p>\n\n\n\n

Estate agents\nare obliged to pass on all offers to the vendor, so if an offer is made which\nis considerably higher than yours you may find yourself gazumped. On property\nwebsites, you\u2019ll often see houses marked \u2018Sold STC\u2019 \u2013 meaning an offer has been\naccepted, but it is still subject to contracts being agreed and exchanged. Some\nestate agents will also continue to host viewings for other potential buyers\nuntil contracts are signed.  <\/p>\n\n\n\n

The frustrating thing is, reaching the important legal milestone of signing contracts comes relatively late on in the process \u2013 after you\u2019ve spent months searching for the property, securing a mortgage, completely the necessary paperwork, and paying solicitors fees. You are also likely to have paid a surveyor to undertake a survey of the property before you sign the contract. So is there anything you can do to avoid being gazumped and safeguard against the expense?<\/p>\n\n\n

Can you avoid being gazumped?<\/strong><\/h3>\n\n\n\n

Again, sadly,\nthe simple answer is no, not completely. You can\u2019t stop the vendor accepting\nanother offer, but what you can do is ensure that you give them as few reasons\nas possible to do so.<\/p>\n\n\n\n

Preparation is\nkey, as always. Make sure you have a mortgage agreement\nin principle<\/a> set\nup beforehand, to make securing your mortgage loan easier (see our comprehensive\nguide to mortgages here<\/a>). Likewise, find a conveyancer<\/a> in advance so\nthat you are ready to instruct them as soon as you find a property you would\nlike to buy.<\/p>\n\n\n\n

Speed is also\nof the essence! Deliver on your side of the sale as quickly as you can, from\nthe offer being accepted to exchange of contracts. Keep in regular contact with\nyour conveyancer and your mortgage lender to keep things moving and make sure\nyou have all of the necessary paperwork ready in advance.<\/p>\n\n\n\n

You should also consider home buyer protection insurance<\/a>. Taking out insurance means that in the event of being gazumped, you can claim back some of the expenses you have already incurred such as solicitors\u2019 fees, and survey costs, so it can certainly be worth it to minimise your risk of losing out financially. Price, exclusions and the events covered vary between providers, so check the policy carefully and don\u2019t assume every failed purchase is covered. <\/p>\n\n\n\n

Get to know the vendors and their estate agent well too, and communicate with them thoroughly. Ensure they know you\u2019re serious and stress how much you love the property. All of this helps build a rapport that can work in your favour.<\/p>\n\n\n\n

If you can, try\nto persuade the vendors to take the house off the market. If it is clear that\nyou are committed to the sale and have offered a favourable price vendors are\noften willing to do this. Or even better, establish a lock-out agreement, in\nwhich the vendor gives you exclusive buying rights for a certain period of time\n(e.g. 10 days) \u2013 this usually entails a deposit payment and some legal fees,\nbut it\u2019s worth it for peace of mind!<\/p>\n\n\n\n
